Ale co kdy\u017e je to jen polovina pravdy? V tomto \u010dl\u00e1nku vysv\u011btl\u00edme, jak\u00e9 oblasti nap\u011bt\u00ed vznikaj\u00ed p\u0159i regulaci, podle jak\u00fdch z\u00e1kladn\u00edch maxim regulace funguje, kter\u00e9 jsou rozhoduj\u00edc\u00ed faktory, podle nich\u017e podniky p\u0159izp\u016fsobuj\u00ed sv\u00e9 chov\u00e1n\u00ed. Nakonec uk\u00e1\u017eeme, pro\u010d p\u0159\u00edstup EU p\u0159esto funguje a vede k velmi dobr\u00fdm v\u00fdsledk\u016fm ... pokud mu to dovol\u00edte.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\"Tanec s regul\u00e1torem\".<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">\"Tanec s regul\u00e1torem\" popisuje strategii, kter\u00e1 popisuje vztahy mezi spole\u010dnostmi a jejich vl\u00e1dn\u00ed regulac\u00ed. V\u00fdsledn\u00e1 \u00favaha zpochyb\u0148uje my\u0161lenku, \u017ee regulace je pro podnik\u00e1n\u00ed omezuj\u00edc\u00ed a p\u0159ek\u00e1\u017eej\u00edc\u00ed. M\u00edsto toho teorie nazna\u010duje, \u017ee mezi podnikem a regul\u00e1torem m\u016f\u017ee vzniknout \"harmonick\u00fd\" tanec. Jasn\u00e9 v\u0161ak je, kter\u00e1 strana tento tanec vede.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z\u00e1kladem je uzn\u00e1n\u00ed, \u017ee spole\u010dnost pot\u0159ebuje pravidla a p\u0159edpisy, aby mohla organizovat spole\u010dn\u00fd \u017eivot a zajistit blahobyt v\u0161ech. Regulace m\u016f\u017ee pomoci zabr\u00e1nit zneu\u017e\u00edv\u00e1n\u00ed, vytvo\u0159it spravedliv\u00e9 podm\u00ednky a zajistit fungov\u00e1n\u00ed syst\u00e9m\u016f. V tomto kontextu zast\u00e1nci t\u00e9to z\u00e1sady navrhuj\u00ed, aby byly regula\u010dn\u00ed org\u00e1ny vn\u00edm\u00e1ny jako partne\u0159i, kte\u0159\u00ed pom\u00e1haj\u00ed polo\u017eit z\u00e1klady \"harmonick\u00e9ho sou\u017eit\u00ed\". T\u00edm je samoz\u0159ejm\u011b my\u0161leno sou\u017eit\u00ed, v n\u011bm\u017e m\u016f\u017ee spole\u010dnost i nad\u00e1le dob\u0159e podnikat. Pro regul\u00e1tora z\u016fst\u00e1v\u00e1 role, v n\u00ed\u017e si m\u016f\u017ee ve\u0159ejn\u011b zachovat tv\u00e1\u0159.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\"Tanec s regula\u010dn\u00edm org\u00e1nem\" uzn\u00e1v\u00e1, \u017ee je t\u0159eba zajistit \"rovnov\u00e1hu\" mezi individu\u00e1ln\u00ed svobodou a kolektivn\u00edmi pot\u0159ebami. V jeho praxi jde \u00fadajn\u011b o respektov\u00e1n\u00ed individu\u00e1ln\u00edch pr\u00e1v a svobod p\u0159i (\u00fadajn\u00e9) ochran\u011b spole\u010dn\u00e9ho dobra.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tanec s regul\u00e1torem je tak\u00e9 o tom, aby regulace byla transparentn\u00ed, spravedliv\u00e1 a p\u0159\u00edstupn\u00e1. Pravidla by m\u011bla b\u00fdt jasn\u011b definovan\u00e1 a srozumiteln\u00e1 pro v\u0161echny, aby ka\u017ed\u00fd m\u011bl mo\u017enost je dodr\u017eovat. Spolupr\u00e1ce mezi jednotlivcem a regul\u00e1torem by m\u011bla b\u00fdt zalo\u017eena na d\u016fv\u011b\u0159e a dialogu s c\u00edlem nal\u00e9zt spole\u010dn\u00e1 \u0159e\u0161en\u00ed a dos\u00e1hnout zlep\u0161en\u00ed. Zn\u00ed to dob\u0159e, \u017ee?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">D\u016fle\u017eitou sou\u010d\u00e1st\u00ed konceptu \"tance s regul\u00e1torem\" je flexibilita. Regulace by podle protagonist\u016f principu tance nem\u011bla b\u00fdt \"rigidn\u00ed\", ale m\u011bla by se um\u011bt p\u0159izp\u016fsobit m\u011bn\u00edc\u00edm se podm\u00ednk\u00e1m a pot\u0159eb\u00e1m. Jeden z nich proto po\u017eaduje pr\u016fb\u011b\u017enou revizi a \u00fapravu specifikac\u00ed, aby bylo zaji\u0161t\u011bno, \u017ee pravidla z\u016fstanou \"\u00fa\u010dinn\u00e1\" a budou odpov\u00eddat \"aktu\u00e1ln\u00edm v\u00fdzv\u00e1m\".<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tanec s regul\u00e1torem je \u010dasto ch\u00e1p\u00e1n tak\u00e9 jako obrazov\u00e1 metafora: metafora nazna\u010duje, \u017ee - podobn\u011b jako v klasick\u00e9m evropsk\u00e9m p\u00e1rov\u00e9m tanci - je t\u0159eba \"p\u0159izp\u016fsobit se jeden druh\u00e9mu\" a \"p\u0159ibl\u00ed\u017eit se k sob\u011b\", aby bylo mo\u017en\u00e9 naj\u00edt spole\u010dnou cestu po kluzk\u00e9m parketu a dos\u00e1hnout \"vyv\u00e1\u017een\u00e9 rovnov\u00e1hy\". V \u017e\u00e1dn\u00e9m p\u0159\u00edpad\u011b by se k sob\u011b nem\u011bli chovat neuctiv\u011b a robustn\u011b.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Spot\u0159ebitel\u00e9 netan\u010d\u00ed spolu<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Brzy se v\u0161ak uk\u00e1\u017ee, \u017ee spot\u0159ebitel\u00e9 netan\u010d\u00ed. \u010casto se nazna\u010duje, \u017ee existuje rovn\u00edtko mezi regula\u010dn\u00edmi org\u00e1ny a spot\u0159ebiteli, ale v praxi je to v\u0161echno, jen ne zaru\u010den\u00e9 nebo dokonce b\u011b\u017en\u00e9. Regul\u00e1tor zpravidla podl\u00e9h\u00e1 p\u0159irozen\u00e9mu konfliktu c\u00edl\u016f: chce jednat na stran\u011b spot\u0159ebitel\u016f a omezovat moc podnik\u016f, nebo chce - zcela naopak - prov\u00e1d\u011bt hospod\u00e1\u0159skou politiku, kter\u00e1 chr\u00e1n\u00ed z\u00e1jmy podnik\u016f.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spole\u010dnosti rychle uv\u00e1d\u011bj\u00ed d\u016fvody, pro\u010d je regulace \"v podstat\u011b mo\u017en\u00e1 v po\u0159\u00e1dku\", ale v praxi \"zach\u00e1z\u00ed p\u0159\u00edli\u0161 daleko\". Obvykle lze nal\u00e9zt n\u00e1sleduj\u00edc\u00ed argumenty:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Slo\u017eitost a byrokracie: Regulace m\u016f\u017ee b\u00fdt \u010dasto slo\u017eit\u00e1 a byrokratick\u00e1. P\u0159\u00edli\u0161 mnoho pravidel a p\u0159edpis\u016f by mohlo omezovat svobodu jedn\u00e1n\u00ed a rozhodov\u00e1n\u00ed a v\u00e9st k vysok\u00e9 administrativn\u00ed z\u00e1t\u011b\u017ei.<\/li>\n\n\n\n<li>Brzd\u011bn\u00ed inovac\u00ed: P\u0159\u00edli\u0161 p\u0159\u00edsn\u00e9 nebo nepru\u017en\u00e9 p\u0159edpisy by \u00fadajn\u011b br\u00e1nily inovac\u00edm a kreativit\u011b. Spole\u010dnosti by n\u00e1sledn\u011b byly odrazov\u00e1ny od realizace nov\u00fdch n\u00e1pad\u016f nebo vstupu na nov\u00e9 trhy, proto\u017ee regulace vytv\u00e1\u0159\u00ed p\u0159\u00edli\u0161 vysok\u00e9 p\u0159ek\u00e1\u017eky.<\/li>\n\n\n\n<li>N\u00e1klady a zdroje: Regulace m\u00e1 svou cenu, a\u0165 u\u017e v podob\u011b poplatk\u016f, \u00fasil\u00ed o dodr\u017eov\u00e1n\u00ed p\u0159edpis\u016f nebo p\u0159inejmen\u0161\u00edm \u00faprav proces\u016f. Zejm\u00e9na pro mal\u00e9 podniky mohou tyto n\u00e1klady p\u0159edstavovat z\u00e1t\u011b\u017e a ovlivnit jejich konkurenceschopnost.<\/li>\n\n\n\n<li>Pomal\u00fd rozhodovac\u00ed proces: Regulace obvykle vy\u017eaduje zdlouhav\u00fd rozhodovac\u00ed proces, kter\u00fd vy\u017eaduje konsensus a koordinaci mezi r\u016fzn\u00fdmi z\u00fa\u010dastn\u011bn\u00fdmi stranami. P\u0159\u00edli\u0161n\u00e9 zam\u011b\u0159en\u00ed na regulaci ur\u010dit\u00fdch aspekt\u016f vede k zanedb\u00e1n\u00ed jin\u00fdch d\u016fle\u017eit\u00fdch aspekt\u016f.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Disproporce je z\u0159ejm\u00e1: zat\u00edmco v\u016f\u010di regul\u00e1torovi se spole\u010dnost bude v\u017edy chovat s v\u00fdjimkou zdvo\u0159ilosti a slu\u0161nosti, na zp\u016fsobu, jak\u00fdm spole\u010dnost jedn\u00e1 se spot\u0159ebiteli a jejich pr\u00e1vy, ve vztahu k regul\u00e1torovi jako tane\u010dn\u00edmu partnerovi nez\u00e1le\u017e\u00ed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Uzav\u0159en\u00ed regul\u00e1toru<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">V praxi je tanec s regul\u00e1torem pouze jednou stranou mince. Druhou stranou t\u00e9\u017ee mince je tzv. regulatory capture. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Koncept \"<strong>Regula\u010dn\u00ed zachycen\u00ed<\/strong>\" ozna\u010duje situaci, kdy jsou regula\u010dn\u00ed org\u00e1ny, kter\u00e9 maj\u00ed ve skute\u010dnosti chr\u00e1nit ve\u0159ejn\u00fd z\u00e1jem, ovliv\u0148ov\u00e1ny z\u00e1jmy t\u011bch, kter\u00e9 maj\u00ed regulovat. Jedn\u00e1 se o (obt\u00ed\u017en\u011b identifikovatelnou) formu lobbingu, kdy soukrom\u00e9 z\u00e1jmy z\u00edsk\u00e1vaj\u00ed kontrolu nad regula\u010dn\u00edm procesem a ovliv\u0148uj\u00ed regula\u010dn\u00ed rozhodov\u00e1n\u00ed ve vlastn\u00edm smyslu. Je to tak\u0159\u00edkaj\u00edc logick\u00e9 pokra\u010dov\u00e1n\u00ed tance. Zat\u00edmco v tanci jde st\u00e1le o vyjedn\u00e1v\u00e1n\u00ed pravidel, podle nich\u017e m\u00e1 regulace prob\u00edhat, \"\u0161ermov\u00e1n\u00ed\" se odehr\u00e1v\u00e1 a\u017e po tanci a zam\u011b\u0159uje se na aplikaci pravidel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V p\u0159\u00edpad\u011b \"regula\u010dn\u00edho zajet\u00ed\" existuje konkr\u00e9tn\u00ed nebezpe\u010d\u00ed, \u017ee regula\u010dn\u00ed org\u00e1ny zanedbaj\u00ed sv\u016fj skute\u010dn\u00fd \u00fakol chr\u00e1nit ve\u0159ejn\u00fd z\u00e1jem a m\u00edsto toho up\u0159ednostn\u00ed z\u00e1jmy regulovan\u00fdch spole\u010dnost\u00ed nebo jin\u00fdch z\u00fa\u010dastn\u011bn\u00fdch stran. To m\u016f\u017ee v\u00e9st k nedostate\u010dn\u011b \u00fa\u010dinn\u00e9mu dohledu nebo nevhodn\u00e9 (slab\u00e9) regulaci.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">K \"regula\u010dn\u00edmu zachycen\u00ed\" m\u016f\u017ee doj\u00edt r\u016fzn\u00fdmi zp\u016fsoby. Jedn\u00edm ze zp\u016fsob\u016f je, \u017ee se regulovan\u00e9 spole\u010dnosti sna\u017e\u00ed ovlivnit regula\u010dn\u00ed proces vyv\u00edjen\u00edm politick\u00e9ho tlaku, nab\u00edzen\u00edm finan\u010dn\u00edch pob\u00eddek nebo zapojen\u00edm do neform\u00e1ln\u00edch s\u00edt\u00ed, aby prosadily sv\u00e9 z\u00e1jmy. Stru\u010dn\u011b \u0159e\u010deno, \"lid\u00e9 se navz\u00e1jem znaj\u00ed\". To m\u016f\u017ee v\u00e9st ke st\u0159etu z\u00e1jm\u016f, proto\u017ee b\u00fdval\u00ed regul\u00e1to\u0159i mohou podporovat vliv odv\u011btv\u00ed, s n\u00edm\u017e d\u0159\u00edve spolupracovali, m\u00edsto aby p\u0159ij\u00edmali objektivn\u00ed rozhodnut\u00ed ve ve\u0159ejn\u00e9m z\u00e1jmu. Nebo naopak: regulace se uk\u00e1\u017ee jako m\u011bk\u010d\u00ed, proto\u017ee akt\u00e9\u0159i regulace doufaj\u00ed v n\u00e1slednou finan\u010dn\u00ed v\u00fdhodu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dopady \"regula\u010dn\u00edho zachycen\u00ed\" mohou b\u00fdt je\u0161t\u011b z\u00e1va\u017en\u011bj\u0161\u00ed ne\u017e dopady \"tance\". Konkr\u00e9tn\u011b m\u016f\u017ee v\u00e9st k naru\u0161en\u00ed trhu, nekal\u00e9 konkurenci, nedostatku odpov\u011bdnosti a ztr\u00e1t\u011b d\u016fv\u011bry v regula\u010dn\u00ed org\u00e1ny. Ve\u0159ejn\u00fd z\u00e1jem a z\u00e1ruky, kter\u00e9 maj\u00ed regulace poskytovat, mohou b\u00fdt v\u00fdznamn\u011b a nep\u0159\u00edzniv\u011b ovlivn\u011bny.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zachycen\u00ed regulace m\u016f\u017ee m\u00edt \u0159adu nep\u0159\u00edzniv\u00fdch d\u016fsledk\u016f. Konkr\u00e9tn\u011b:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>St\u0159ety z\u00e1jm\u016f: \"regula\u010dn\u00ed zajet\u00ed\" m\u016f\u017ee v\u00e9st k v\u00e1\u017en\u00fdm st\u0159et\u016fm z\u00e1jm\u016f, pokud regula\u010dn\u00ed org\u00e1ny zastupuj\u00ed p\u0159edev\u0161\u00edm z\u00e1jmy regulovan\u00fdch spole\u010dnost\u00ed nebo konkr\u00e9tn\u00edch z\u00e1jmov\u00fdch skupin, a nikoli ve\u0159ejn\u00fd z\u00e1jem. To vede ke ztr\u00e1t\u011b nez\u00e1vislosti a schopnosti p\u0159ij\u00edmat objektivn\u00ed a vyv\u00e1\u017een\u00e1 rozhodnut\u00ed.<\/li>\n\n\n\n<li>Ochrana zaveden\u00e9 tr\u017en\u00ed s\u00edly: Pokud regulovan\u00e9 spole\u010dnosti z\u00edskaj\u00ed kontrolu nad regula\u010dn\u00edmi org\u00e1ny nebo procesy, mohou regulaci vyu\u017e\u00edt ve sv\u016fj prosp\u011bch k ochran\u011b nebo roz\u0161\u00ed\u0159en\u00ed sv\u00e9 tr\u017en\u00ed s\u00edly. To m\u016f\u017ee v\u00e9st ke vzniku monopol\u016f nebo oligopol\u016f a k v\u00fdrazn\u00e9mu omezen\u00ed konkurence na trhu, co\u017e n\u00e1sledn\u011b vede k vy\u0161\u0161\u00edm cen\u00e1m a men\u0161\u00edmu v\u00fdb\u011bru pro spot\u0159ebitele.<\/li>\n\n\n\n<li>Oslaben\u00ed pr\u00e1v spot\u0159ebitel\u016f: \"regula\u010dn\u00ed z\u00e1bor\" m\u016f\u017ee v\u00e9st k zanedb\u00e1v\u00e1n\u00ed pr\u00e1v spot\u0159ebitel\u016f. Regula\u010dn\u00ed org\u00e1ny se mohou zdr\u00e1hat skute\u010dn\u011b prosazovat p\u0159\u00edsn\u00e9 p\u0159edpisy pro podniky, kter\u00e9 maj\u00ed chr\u00e1nit spot\u0159ebitele. To m\u016f\u017ee v\u00e9st k ni\u017e\u0161\u00ed kvalit\u011b v\u00fdrobk\u016f nebo slu\u017eeb, nedostate\u010dn\u00e9 transparentnosti, nadm\u011brn\u00e9 regulaci nebo nedostate\u010dn\u00e9 ochran\u011b soukrom\u00ed.<\/li>\n\n\n\n<li>Ztr\u00e1ta d\u016fv\u011bry ve\u0159ejnosti: Pokud jsou regula\u010dn\u00ed org\u00e1ny vn\u00edm\u00e1ny jako sou\u010d\u00e1st probl\u00e9mu a jejich rozhodnut\u00ed jsou pova\u017eov\u00e1na za motivovan\u00e1 z\u00e1jmy soukrom\u00e9ho sektoru, vede to ke ztr\u00e1t\u011b d\u016fv\u011bry ve\u0159ejnosti. Ve\u0159ejnost m\u016f\u017ee pochybovat o \u00fa\u010dinnosti a integrit\u011b regulace, co\u017e ovliv\u0148uje celkov\u00e9 p\u0159ijet\u00ed a legitimitu regula\u010dn\u00edch opat\u0159en\u00ed.<\/li>\n\n\n\n<li>Nedostatek inovac\u00ed a pokroku: Pokud jsou regula\u010dn\u00ed org\u00e1ny ovliv\u0148ov\u00e1ny z\u00e1jmy regulovan\u00fdch spole\u010dnost\u00ed, hroz\u00ed, \u017ee budou potla\u010deny nov\u00e9 inovativn\u00ed p\u0159\u00edstupy nebo alternativn\u00ed \u0159e\u0161en\u00ed. To m\u016f\u017ee v\u00e9st k zaost\u00e1v\u00e1n\u00ed v oblasti inovac\u00ed, proto\u017ee spole\u010dnosti, kter\u00e9 t\u011b\u017e\u00ed ze st\u00e1vaj\u00edc\u00edch regulac\u00ed, nemaj\u00ed p\u0159\u00edli\u0161 velkou motivaci vyv\u00edjet nov\u00e9 technologie nebo postupy, kter\u00e9 by mohly b\u00fdt lep\u0161\u00ed alternativou.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Je d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee regula\u010dn\u00ed z\u00e1bor negativn\u011b ovliv\u0148uje i mal\u00e9 podniky a za\u010d\u00ednaj\u00edc\u00ed podniky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tyto nep\u0159\u00edzniv\u00e9 dopady regula\u010dn\u00edho zajet\u00ed zd\u016fraz\u0148uj\u00ed pot\u0159ebu p\u0159ijmout opat\u0159en\u00ed k zaji\u0161t\u011bn\u00ed nez\u00e1vislosti a integrity regula\u010dn\u00edch org\u00e1n\u016f. \u00da\u010dinn\u00fd dohled, p\u0159\u00edsn\u00e1 etick\u00e1 pravidla, transparentnost a siln\u00e1 \u00fa\u010dast ob\u010dansk\u00e9 spole\u010dnosti mohou pomoci minimalizovat rizika ovl\u00e1dnut\u00ed regula\u010dn\u00edch org\u00e1n\u016f a zajistit, aby regulace byla skute\u010dn\u011b ve ve\u0159ejn\u00e9m z\u00e1jmu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Reakce EU: regul\u00e1to\u0159i ob\u010dansk\u00e9 spole\u010dnosti<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">EU si ji\u017e na po\u010d\u00e1tku stanovila c\u00edl dos\u00e1hnout jedn\u00e9 z nejvy\u0161\u0161\u00edch a nejlep\u0161\u00edch \u00farovn\u00ed ochrany pr\u00e1v spot\u0159ebitel\u016f na sv\u011bt\u011b. A v roce 2020 tohoto c\u00edle podle mnoha pozorovatel\u016f z cel\u00e9ho sv\u011bta tak\u00e9 dos\u00e1hla. Je to o to p\u0159ekvapiv\u011bj\u0161\u00ed, \u017ee v EU neexistuj\u00ed \u017e\u00e1dn\u00e9 donucovac\u00ed org\u00e1ny. Neexistuje tedy \u017e\u00e1dn\u00e1 policie EU, kter\u00e1 by chr\u00e1nila spot\u0159ebitele. Nam\u00edsto toho musely pr\u00e1vn\u00ed akty Unie v\u017edy prosazovat vnitrost\u00e1tn\u00ed org\u00e1ny. A zde se velmi rychle objevila opozice v\u016f\u010di \"pravidl\u016fm z Bruselu\". D\u016fsledkem byl tzv.<strong>Nedostate\u010dn\u00e9 vym\u00e1h\u00e1n\u00ed pr\u00e1va<\/strong>\" v rozs\u00e1hl\u00fdch \u010d\u00e1stech pr\u00e1va Unie. Situace vedla k mno\u017estv\u00ed vtip\u016f a cynick\u00fdch koment\u00e1\u0159\u016f. Existovala nap\u0159\u00edklad n\u011bmeck\u00e1 \u0159\u00edkanka: \"Erdacht in Br\u00fcssel, zuhause verlacht\" (v Bruselu vymy\u0161leno, doma vysm\u00e1to) nebo \"gelesen, gelacht, gelocht\" (p\u0159e\u010dteno, vysm\u00e1to, vyra\u017eeno).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dlouhou dobu bylo nejprve pr\u00e1vo Spole\u010denstv\u00ed a pot\u00e9 pr\u00e1vo Unie pap\u00edrov\u00fdmi tygry: na pap\u00ed\u0159e skv\u011bl\u00e9, v praxi de facto ne\u00fa\u010dinn\u00e9. Odpov\u011b\u010f Bruselu na tento \u017ealostn\u00fd stav - z pohledu Parlamentu EU a Komise - p\u0159i\u0161la pozd\u011b, ale p\u0159ece. Kompetence \u010dlensk\u00fdch st\u00e1t\u016f v oblasti vym\u00e1h\u00e1n\u00ed pr\u00e1va nebyly ot\u0159eseny, ale bylo zaji\u0161t\u011bno, \u017ee vym\u00e1h\u00e1n\u00ed pr\u00e1va mohou v\u017edy prov\u00e1d\u011bt nez\u00e1visl\u00e1 sdru\u017een\u00ed na ochranu spot\u0159ebitel\u016f (v \u017eargonu EU pon\u011bkud neromanticky naz\u00fdvan\u00e1 \"kvalifikovan\u00e9 subjekty\"). Cesta sem nebyla proch\u00e1zkou r\u016f\u017eov\u00fdm sadem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na po\u010d\u00e1tku 90. let 20. stolet\u00ed zah\u00e1jila EU legislativn\u00ed iniciativu na ochranu spot\u0159ebitel\u016f p\u0159ed. <strong>Nespravedliv\u00e9 smluvn\u00ed podm\u00ednky<\/strong> (<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:31993L0013\">https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/HTML\/?uri=CELEX:31993L0013<\/a>). Tato sm\u011brnice sice je\u0161t\u011b nezaji\u0161\u0165ovala kolektivn\u00ed od\u0161kodn\u011bn\u00ed, ale n\u00e1sledn\u011b se uk\u00e1zalo, \u017ee je m\u00e1lo u\u017eite\u010dn\u00e9 ukl\u00e1dat jednotlivc\u016fm pr\u00e1vn\u00ed ochranu proti nep\u0159im\u011b\u0159en\u00fdm podm\u00ednk\u00e1m, a v n\u00e1sleduj\u00edc\u00edm legislativn\u00edm obdob\u00ed byla p\u0159ijata sm\u011brnice EU o \u017ealob\u00e1ch na zdr\u017een\u00ed se jedn\u00e1n\u00ed (<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/ALL\/?uri=CELEX%3A31998L0027\">Sm\u011brnice 98\/27\/ES o opat\u0159en\u00edch na ochranu z\u00e1jm\u016f spot\u0159ebitel\u016f p\u0159i zastaven\u00ed \u010dinnosti (Directive 98\/27\/CE relative aux actions en cessation en mati\u00e8re de protection des int\u00e9r\u00eats des consommateurs)<\/a>) byly p\u0159ijaty. Tyto a n\u00e1sledn\u00e9 pr\u00e1vn\u00ed akty EU vedly ke zm\u011bn\u011b paradigmatu v praxi vym\u00e1h\u00e1n\u00ed pr\u00e1va. Podniky nyn\u00ed ne\u010delily pouze \u00fast\u0159edn\u00edmu dozorov\u00e9mu org\u00e1nu (s n\u00edm\u017e m\u011bly dlouholet\u00e9 zku\u0161enosti), ale mnoha sdru\u017een\u00edm r\u016fzn\u00e9 struktury, zam\u011b\u0159en\u00ed a velikosti, z nich\u017e v\u0161echna mohla podat \u017ealobu. Alespo\u0148 teoreticky. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Po dlouhou dobu v\u0161ak z\u016fst\u00e1vala rozhoduj\u00edc\u00ed chyba: kdo <strong>Kvalifikovan\u00e1 instituce<\/strong> je a z\u016fst\u00e1v\u00e1 na rozhodnut\u00ed \u010dlensk\u00fdch st\u00e1t\u016f. Neexistovaly t\u00e9m\u011b\u0159 \u017e\u00e1dn\u00e9 po\u017eadavky, kter\u00e9 by sdru\u017een\u00ed musela splnit, aby se stala kvalifikovan\u00fdm subjektem a m\u011bla tak pr\u00e1vo \u017ealovat. Bylo pouze stanoveno, \u017ee v ka\u017ed\u00e9m \u010dlensk\u00e9m st\u00e1t\u011b mus\u00ed existovat alespo\u0148 jeden takov\u00fd kvalifikovan\u00fd subjekt. Rozhodnut\u00ed o tom, kdo m\u016f\u017ee p\u016fsobit jako regul\u00e1tor ob\u010dansk\u00e9 spole\u010dnosti, se tak stalo politick\u00fdm rozhodnut\u00edm a lobbistick\u00e1 bitva se p\u0159esunula na postaven\u00ed [<a href=\"https:\/\/www.wiwo.de\/politik\/deutschland\/faktencheck-wie-serioes-ist-die-deutsche-umwelthilfe\/23937452.html\">1<\/a>, <a href=\"https:\/\/www.zeit.de\/politik\/deutschland\/2018-12\/deutsche-umwelthilfe-unionsfraktion-verbandsklage-einschraenkung?utm_referrer=https%3A%2F%2Fwww.google.com%2F\">2<\/a>, <a href=\"https:\/\/taz.de\/Friedrich-Merz-gegen-Umweltverbaende\/!5800010\/\">3<\/a>].<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"659\" src=\"https:\/\/euroconsum.eu\/wp-content\/uploads\/2023\/05\/image-1024x659.png\" alt=\"\" class=\"wp-image-3720\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Obzvl\u00e1\u0161t\u011b negativn\u00edm p\u0159\u00edkladem zneu\u017eit\u00ed z\u00e1v\u011bsn\u00e9ho postaven\u00ed Mitgliesov\u00fdch st\u00e1t\u016f je v\u0161ak tak\u00e9 tzv. <strong>Rakousk\u00e1 republika<\/strong>. Je tomu tak proto, \u017ee tam bylo pr\u00e1vo \u017ealovat upraveno pr\u00e1vn\u00edm p\u0159edpisem na feder\u00e1ln\u00ed \u00farovni, kter\u00fd p\u0159\u00edmo p\u0159izn\u00e1val status kvalifikovan\u00e9ho subjektu. Obecn\u00fd p\u0159\u00edstupov\u00fd postup pro nov\u00e1 sdru\u017een\u00ed tam dlouho neexistoval. Nap\u0159\u00edklad organizace EU pro ochranu \u00fadaj\u016f NOYB, kter\u00e1 m\u00e1 s\u00eddlo v Rakousku, proto dlouho nem\u011bla \u017ealobn\u00ed legitimaci. Nakonec z\u00edskala zp\u016fsobilost k pod\u00e1n\u00ed \u017ealoby v Belgii prost\u0159ednictv\u00edm <a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi\/article_body.pl?numac=2020015708&amp;caller=list&amp;article_lang=F&amp;row_id=1&amp;numero=1&amp;pub_date=2020-10-08&amp;language=fr&amp;du=d&amp;fr=f&amp;choix1=ET&amp;choix2=ET&amp;fromtab=+moftxt+UNION+montxt+UNION+modtxt&amp;nl=n&amp;trier=promulgation&amp;text1=noyb&amp;sql=((+htit+contains++(+%27noyb%27)++++++)+or+(+text+contains++(+%27noyb%27)++++++))&amp;rech=2&amp;tri=dd+AS+RANK+#top\">ministersk\u00fd v\u00fdnos<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na str\u00e1nk\u00e1ch <strong>Spolkov\u00e1 republika N\u011bmecko<\/strong> byla a je n\u00e1padn\u00e1 tak\u00e9 t\u00edm, \u017ee sice zavedla akredita\u010dn\u00ed postup pro nov\u00e9 kvalifikovan\u00e9 instituce, ale z\u00e1rove\u0148 stanovila mno\u017estv\u00ed n\u011bkdy protich\u016fdn\u00fdch p\u0159edpis\u016f, kter\u00e9 mus\u00ed sdru\u017een\u00ed splnit, aby se mohla st\u00e1t kvalifikovanou instituc\u00ed. Na adrese <strong>Italsk\u00e1 republika<\/strong> na druhou stranu byl n\u00e1padn\u00fd t\u00edm, \u017ee vy\u017eadoval extr\u00e9mn\u011b vysok\u00fd po\u010det \u010dlen\u016f (n\u011bkolik tis\u00edc \u010dlen\u016f z r\u016fzn\u00fdch \u010d\u00e1st\u00ed zem\u011b).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\"Dieselgate\"<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Nakonec p\u0159i\u0161la \"Dieselgate\". Slovo \"Dieselgate\" ozna\u010duje skand\u00e1l, kter\u00fd v roce 2015 ot\u0159\u00e1sl n\u011bmeck\u00fdm koncernem Volkswagen a pozd\u011bji se dotkl i dal\u0161\u00edch, p\u0159edev\u0161\u00edm n\u011bmeck\u00fdch v\u00fdrobc\u016f automobil\u016f. Zjistilo se, \u017ee Volkswagen a jeho dce\u0159in\u00e9 spole\u010dnosti prov\u00e1d\u011bly softwarov\u00e9 manipulace na vozidlech s dieselov\u00fdmi motory s c\u00edlem manipulovat s \u00farovn\u00ed emis\u00ed p\u0159i testech. Posti\u017een\u00e1 vozidla se tv\u00e1\u0159ila, \u017ee spl\u0148uj\u00ed p\u0159\u00edsn\u00e9 ekologick\u00e9 p\u0159edpisy, a p\u0159itom v b\u011b\u017en\u00e9m silni\u010dn\u00edm provozu vypou\u0161t\u011bla mnohem vy\u0161\u0161\u00ed mno\u017estv\u00ed \u0161kodlivin. Toto odhalen\u00ed m\u011blo celosv\u011btov\u00fd dopad na automobilov\u00fd pr\u016fmysl a vedlo k masivn\u00edmu stahov\u00e1n\u00ed vozidel z trhu, pr\u00e1vn\u00edm d\u016fsledk\u016fm, pokut\u00e1m a v\u00fdrazn\u00e9 ztr\u00e1t\u011b reputace spole\u010dnosti Volkswagen. Skand\u00e1l Dieselgate zv\u00fd\u0161il pov\u011bdom\u00ed o pot\u0159eb\u011b p\u0159\u00edsn\u011bj\u0161\u00edch emisn\u00edch norem a transparentn\u011bj\u0161\u00edch testovac\u00edch postup\u016f v automobilov\u00e9m pr\u016fmyslu. St\u00e1ty - p\u0159edev\u0161\u00edm N\u011bmecko - v\u0161ak m\u011bly pot\u00ed\u017ee s prosazov\u00e1n\u00edm pr\u00e1v spot\u0159ebitel\u016f.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na str\u00e1nk\u00e1ch <a href=\"https:\/\/en.wikipedia.org\/wiki\/Juncker_Commission\">Komise Juncker<\/a> nakonec tuto ud\u00e1lost vyu\u017eil jako p\u0159\u00edle\u017eitost k rozs\u00e1hl\u00e9 legislativn\u00ed iniciativ\u011b: \"<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/IP_18_3041\">Nov\u00e1 dohoda pro spot\u0159ebitele<\/a>\". Sou\u010d\u00e1st\u00ed p\u0159\u00edstupu New Deal byla reorganizace vym\u00e1h\u00e1n\u00ed pr\u00e1va. M\u011blo by b\u00fdt mo\u017en\u00e9 bez probl\u00e9m\u016f vym\u00e1hat pr\u00e1va spot\u0159ebitel\u016f p\u0159es hranice. Krom\u011b toho by poprv\u00e9 v EU m\u011bla existovat jednotn\u00e1 pravidla pouze pro soudn\u00ed z\u00e1kazy, ale tak\u00e9 pro n\u00e1hradu \u0161kody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Komise a Parlament byly rychle p\u0159esv\u011bd\u010deny, ale Rada, v n\u00ed\u017e jsou zastoupeny vl\u00e1dy \u010dlensk\u00fdch st\u00e1t\u016f, dala najevo, \u017ee nov\u00e1 pravidla nechce podpo\u0159it, a iniciativa se tak dostala do slep\u00e9 uli\u010dky. N\u00e1sledoval zdlouhav\u00fd a podle v\u0161eho velmi obt\u00ed\u017en\u00fd proces. <a href=\"https:\/\/de.wikipedia.org\/wiki\/Trilog\">Postup trialogu<\/a>. Hlavn\u00edm sporn\u00fdm bodem byla ot\u00e1zka, jak\u00e1 krit\u00e9ria mus\u00ed kvalifikovan\u00e9 subjekty spl\u0148ovat, aby mohly v budoucnu pod\u00e1vat \u017ealoby.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z kruh\u016f z\u00fa\u010dastn\u011bn\u00fdch jsme se dozv\u011bd\u011bli, \u017ee jeden velk\u00fd \u010dlensk\u00fd st\u00e1t pr\u00fd dohodu prost\u0159ednictv\u00edm Rady dlouho blokoval, proto\u017ee m\u011bl zvl\u00e1\u0161tn\u00ed z\u00e1jem na tom, aby mohl kvalifikovanou instituci, kter\u00e1 je jist\u011b obzvl\u00e1\u0161t\u011b ochotn\u00e1 \u017ealovat a nakonec se j\u00ed nel\u00edb\u00ed, vylou\u010dit z pr\u00e1va \u017ealovat podle vnitrost\u00e1tn\u00edho pr\u00e1va. To v\u0161ak nelze prok\u00e1zat. Pro n\u011bmeck\u00e9 automobilky v\u0161ak bylo i odlo\u017een\u00ed sm\u011brnice \u00fasp\u011bchem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dohoda byla t\u00e9m\u011b\u0159 \u0161alamounsk\u00e1: podle kompromisn\u00edho zn\u011bn\u00ed si \u010dlensk\u00e9 st\u00e1ty ponechaly mo\u017enost stanovit vlastn\u00ed krit\u00e9ria pro n\u00e1rodn\u00ed kvalifikovan\u00e9 subjekty. Na druhou stranu musel ka\u017ed\u00fd \u010dlensk\u00fd st\u00e1t umo\u017enit zahrani\u010dn\u00edmu kvalifikovan\u00e9mu subjektu podat \u017ealobu u vnitrost\u00e1tn\u00edch soud\u016f. Krom\u011b toho musel b\u00fdt v ka\u017ed\u00e9 zemi v cel\u00e9 Unii zaveden jednotn\u00fd postup pro z\u00edsk\u00e1n\u00ed zp\u016fsobilosti k pod\u00e1n\u00ed \u017ealoby v zahrani\u010d\u00ed. Tak\u017ee zat\u00edmco nap\u0159\u00edklad N\u011bmecko si mohlo zachovat komplexn\u00ed soubor pravidel pro kvalifikovan\u00e9 subjekty, pokud kvalifikovan\u00fd subjekt s\u00eddlil v N\u011bmecku a pod\u00e1val \u017ealoby v N\u011bmecku, muselo z\u00e1rove\u0148 zav\u00e9st postup, podle kter\u00e9ho muselo n\u011bmeck\u00e9 sdru\u017een\u00ed z\u00edskat zp\u016fsobilost k pod\u00e1n\u00ed \u017ealoby mimo N\u011bmecko.
